Terms of Service

These Terms of Service (“Terms”) govern your use of Template Email (“Template Email”, “the service”, “we”, “us”), available at templateemail.com and operated by The3DFella. By signing in or using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Template Email.

1. What Template Email does

Template Email lets you design email templates, personalize them for each recipient, and send them from your own Gmail account. It can also suggest recipients from your Google contacts and keep a list of the emails you sent through the service. Emails are sent by Google's Gmail service, under your account, one recipient at a time, only when you choose to send them.

2. Your account

• You sign in with a Google account. You must be at least 16 years old, and old enough to agree to these Terms where you live.
• You are responsible for everything done through your account and for keeping your Google account secure.
• If you use Template Email for a business or organization, you confirm that you are allowed to accept these Terms for it.
• Tell us right away at templateemail@the3dfella.com if you think someone has used your account without permission.

3. Google permissions

To work, Template Email asks for permission to send email from your Gmail account and to read your Google contacts. It never asks for permission to read your Gmail. Our Privacy Policy explains what each permission is used for. You can revoke access at any time at myaccount.google.com/permissions, but some or all features will stop working. Your use of Gmail and other Google services also remains subject to Google's own terms.

4. Acceptable use

You are responsible for the emails you send and who you send them to. You agree not to use Template Email to:

• send spam, unsolicited bulk or commercial email, or email to people who have not agreed to hear from you where the law requires it;
• break anti-spam and marketing laws, such as CAN-SPAM, CASL, GDPR, PECR, or similar laws where you or your recipients are;
• send phishing, scams, malware, or messages that pretend to be someone else or hide who sent them;
• send content that is illegal, harassing, threatening, hateful, sexually exploitative, or that infringes someone else's rights;
• upload images or content you do not have the right to use;
• break Google's terms or policies, including Gmail sending limits;
• attempt to access other users' data, probe or attack the service, or get around its limits or security;
• copy, resell, or automate the service in ways it is not designed for, such as scraping or bulk sending scripts.

If you send commercial email, you are responsible for including any information the law requires, such as your identity, a physical address, and a way to unsubscribe, and for honoring opt-out requests.

5. Your content

• You keep ownership of everything you create or upload, including templates, text, images, and brand settings (“Your Content”).
• You give us a limited permission to store, process, display, and send Your Content only as needed to run the service for you. This permission ends when you delete the content or your account, except for copies we must keep by law.
• You confirm that you have the rights needed for Your Content and that it does not break these Terms or the law.
• We do not claim ownership of Your Content and do not use it for advertising or to train AI models.

6. Our service

Template Email, including its software, design, and built-in templates and presets, belongs to us. You may use built-in templates and presets in the emails you send. Apart from that, these Terms do not give you any rights to our name, logo, or software.

7. Price

Template Email is currently free to use. If we introduce paid features, we will tell you in advance, and you will not be charged unless you choose to sign up for them.

8. Availability and changes

We try to keep Template Email running smoothly, but we do not promise it will always be available, fast, or error-free. It depends on outside services such as Google and Cloudflare. We may add, change, or remove features, and we will give reasonable notice of significant changes where we can. Keep your own copies of anything important.

9. Suspension and ending your use

• You can stop using Template Email at any time. To delete your account and data, follow the steps in our Privacy Policy.
• We may suspend or close your account if you break these Terms, if your use creates legal or security risk, harms other people, or threatens Google's or our services, or if the law requires it. Where reasonable, we will tell you why and give you a chance to fix the problem first.
• If we stop offering the service entirely, we will give at least 30 days' notice where we can, so you can save your templates.

10. Disclaimer

Template Email is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that emails will be delivered, reach the inbox rather than spam, or get a reply. Delivery is handled by Gmail and the recipient's email provider.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the service. Our total liability for any claim related to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or USD $50. Some places do not allow these limits, so they may not fully apply to you. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to cover our costs, including reasonable legal fees, for claims by others that arise from the emails you send, Your Content, or your breach of these Terms or the law.

13. Changes to these Terms

We may update these Terms from time to time. We will change the “Last updated” date above and, for significant changes, tell you in the app or by email before they take effect. If you keep using Template Email after changes take effect, you accept the updated Terms. If you do not agree, stop using the service.

14. General

• These Terms and the Privacy Policy are the whole agreement between you and us about Template Email.
• If any part of these Terms cannot be enforced, the rest stays in effect.
• If we do not enforce a part of these Terms right away, we can still enforce it later.
• You may not transfer your rights under these Terms without our permission. We may transfer ours as part of a merger, acquisition, or sale of the service.
• These Terms are governed by the laws of the place where the operator is based, without regard to conflict-of-law rules. This does not take away any consumer protection rights you have under the laws of where you live.
